Happy Christmas from the ICO - Data Protection Fee
Have you received a letter from the ICO about an unpaid data protection fee? Before you pay, do check whether you need to.
I have been asked a number of times whether the letter some companies have received this month from the ICO about an unpaid data protection fee is a hoax. It is not (although, as money is involved, the ICO is warning of potential scammers).
Whether you need to pay is another matter. You may well be exempt. An example would be if you only store and process personal data related to your employees, for management of your business finances and for promotion of your business.
Go through the ICO's self assessment to check.
Do take care when you get to Section 7 'Are you processing information for any of the following purposes'. The list is clearer than it used to be, but to take 'Pensions Administration' as an example, are you an administrator of this information or is it handed over to a pensions provider?
If you are exempt be sure to fill in the ICO's exemption form to let them know why.
